Acceptance of Terms

By accessing or using TextKit API, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service.

Service Description

TextKit API is an AI-powered text processing service providing endpoints for content repurposing, summarization, rewriting, SEO optimization, and more. The service is provided through a RESTful API accessible to registered users.

Account & API Keys

You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

Acceptable Use

You agree NOT to:

• Use the service for illegal purposes or in violation of any applicable laws
• Send content that violates third-party intellectual property rights, privacy rights, or other rights
• Attempt to reverse-engineer, decompile, or extract the source code of the API
• Resell or redistribute API access without our written permission
• Exceed rate limits or attempt to circumvent usage restrictions through technical means
• Send malicious content designed to exploit, manipulate, or abuse the AI model
• Use the service to generate spam, misleading content, or content intended to deceive

Billing & Payments

Billing is handled through Stripe, our third-party payment processor. Subscriptions are billed monthly on the anniversary of your subscription date. You may cancel your subscription at any time; your access will continue until the end of your current billing period. We do not offer refunds for partial months of service. We reserve the right to change our pricing with 30 days advance notice to active subscribers.

Intellectual Property

You retain full ownership of all content you submit to the API. We retain ownership of the API, documentation, service infrastructure, and all related technology. Output generated by the API in response to your requests is yours to use as you see fit, subject to these terms and applicable law.

Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. IN NO EVENT SHALL TEXTKIT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO TEXTKIT IN THE 12 MONTHS PRECEDING THE CLAIM.

Data Processing

Your content may be sent to third-party AI providers (including OpenAI) for processing. We do not use your submitted content to train our models or those of third parties. For more information about how we handle your data, please see our Privacy Policy.

Termination

We may suspend or terminate your account and access to the service at any time for violations of these terms or for any other reason at our discretion. You may cancel your account at any time through your dashboard or by contacting support. Upon termination, your access to the service will cease, though we may retain certain data as required by law or our Privacy Policy.

Modifications

We may update these Terms of Service at any time. We will notify you of material changes by email or through a notice on our website. Your continued use of the service after such changes constitutes your acceptance of the new terms.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be resolved in the courts of Canada.
